Terms of Service
These Terms of Service ("Terms") govern your access to and use of Wrx and related services (the "Service"), operated by Aditya (independent developer) ("we," "our," or "us"). By accessing or using the Service, you agree to these Terms.
1. Eligibility and Acceptance
You represent that you are legally able to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Service Description
Wrx provides workout planning, routine creation, session tracking, and related account features. We may update, modify, or discontinue parts of the Service at any time.
3. Paid Features and Subscriptions
Certain features of the Service may require payment or a subscription ("Paid Features"). Any pricing, billing terms, renewal details, and applicable trial terms will be shown to you at the time of purchase.
- Billing through Apple: If you purchase Paid Features on iOS/watchOS, payment is processed by Apple using In-App Purchase, and your purchase is subject to Apple's terms and policies (including refunds).
- Auto-renewal: Subscriptions (if offered) renew automatically unless canceled at least 24 hours before the end of the current billing period, as managed in your Apple account settings.
- Changes: We may change pricing or the features included in a plan. Where required, we will provide reasonable notice (and for Apple subscriptions, changes may be handled via Apple's subscription change flow).
4. Accounts and Authentication
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for activity under your account, except where caused by our breach of security obligations.
- You agree to provide accurate account information and keep it current.
5. Acceptable Use
You agree not to:
- Use the Service in violation of applicable laws or regulations.
- Interfere with Service integrity, security, or performance.
- Attempt unauthorized access to systems or user data.
- Reverse engineer or misuse the Service beyond what is permitted by law.
6. Intellectual Property
The Service, including software, branding, and content, is owned by us or our licensors and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal use.
7. User Content
You retain rights in the workout data and content you submit (for example routines, exercises, sets, reps, and weight history). You grant us a limited license to host, process, and display such content only as needed to provide and improve the Service.
8. Third-Party Services
The Service may integrate with third-party providers such as authentication, payments, or infrastructure services. Your use of third-party services is subject to their terms and policies.
9. Health and Fitness Disclaimer
The Service provides informational tools and is not medical advice. Consult qualified professionals before starting or changing any exercise program. You use the Service at your own risk.
HealthKit: If you choose to connect Apple Health / HealthKit, Wrx may write workout data such as workout time duration, calories burned, and heart rate information to HealthKit at your direction. Wrx does not read Apple Health data and does not provide medical diagnosis or treatment.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data.
To the maximum extent permitted by law, our aggregate liability for claims relating to the Service will not exceed the greater of (a) $100 USD or (b) the total amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising from your misuse of the Service or your violation of these Terms, to the extent permitted by law.
13. Termination
We may suspend or terminate access if you violate these Terms or where needed for security/legal reasons. You may stop using the Service at any time.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in Pinellas County, Florida, unless required otherwise by law.
15. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Continued use of the Service after the updated Terms become effective constitutes acceptance.
